Typically, Command + Option + Shift + Delete will remove locked files from the trash. Like theras2000 said reboot and try again.
If that doesn't do it you can create a folder on your desktop called "garbage" and move everything out of your trash into the folder. Then, go to Applications > Utilities > Terminal > and type this command in the terminal (enter your password when prompted. This will instantly delete "garbage"):
sudo rm -R ~/Desktop/garbage
Or, you can move everything to the garbage folder and unlock items recursively with batchmod: http://www.versiontracker.
