If the drive came with the Dell system, it's an OEM drive and Maxtor will NOT honor any warranty for you directly. Your only way to claim any warranty is through Dell. If the system is out of warranty, the drive is also out of warranty.
The only warranties that Maxtor will honor for consumers are those for drives purchased at retail and which were retail packaged.
Just to add a comment: Dell doesn't provide any cooling for hard drives. When Dell replaces the hard drive, buy a hard drive cooler, and put it in with the drive. This will greatly prolong the life of your hard drive.

what Dell usually does from what some of my customers tell me, apparently they have contracts with local computer repair facilities. Dell will call them and they will stop by. One lady I went to, the PC repair tech that Dell sent took the crashed HD out put in a new one and said there you go. Would not xfer any files ( the drive was still partly ok) or install the OS from the recovery cd, this was an old lady. you know make sure the pc worked ok, could get on the net ...etc.
Ah, server support, it should be golden, Dell should either expedite you one next day, or come and swap it out for you. If it's consumer level support, then you'll have to put up with....

hiroyuki718 What is the HD exactly doing ? Most HD manufacturers on their web sites have free diagnostics that will fit on a floppy that you can boot from that will diag the HD. I think as all of us as techs when we hear a HD has crashed and a new one is needed , we assume that is the case. So when you say crashed, what exactly are you seeing when the pc boots, any errors ... etc. You may just need to reload the OS.

I would first contact DELL - If covered they should be able to expedite a replacement. If they tell you that you don't have a warranty or that it expired, then I would contact Maxtor and deal with them. I dealt with both, and maxtor takes a little longer to get a replacement, especially if you have to send in your bad drive first. You can do some kind of an exchange, but they will ask for your CC number so that they can be sure - that you will return the bad one.
