hi i have a laptop which im going to format and put win98 se on it, but i have to problems the first being that i dont have a code for the disk and its the offical disk not a copy, & my other question is once its formated willthere be a bios or will it not be nessecresary to have one during the installation?

get a boot disk from www.bootdisk.com
You will still need a code to reinstall 98. Since you can't boot it to retrieve the current code you need to contact MS as already suggested.

The Magical Jelly Bean Keyfinder is a freeware utility that retrieves your Product Key (cd key) used to install windows from your registry. It has the options to copy the key to clipboard, save it to a text file, or print it for safekeeping. It works on Windows 95, 98, ME, NT4, 2000, XP, Server 2003, Office 97, and Office XP.
NB you can back up the wpa.dbl file (This is a copy of the unlock code for your OS) file to a floppy disk (It lives in C:\windows\system32) when you’ve rebuilt your PC copy it back and you wont have to re-register.
dont worry about you BIOS it will be protected by the little battery on the motherboard
