Restore that file/folder, then go back and delete it again. Maybe try renaming it first if that doesn't work.

too late i went in and deleted things manually out of the Recycle Bin

i click restore all items and then its empty. As soon as i put something in there it wont empty

yea. but it acts like its not. the icon shows it as full. i create a new folder on the desktop and place it in there and then i try to empty and get the error

Try rebooting in safe mode and emptying it.

Download this reg file to your desktop.
Double-click to run it.
Select "Yes" to merge with registry
reboot.
delete a file and test for proper operation.
