I'd start here:
A Volume Shadow Copy Service (VSS) update package is available for Windows Server 2003
http://support.microsoft.com/?kbid=833167

Check Veritas as well; there are several hotfixes out since 9.1.

There is a newer version of that rollup avaiable. since you have to call MS anyway to get the hotfix, ask for the more recent version of the rollup package. It came out last month but I don't remember the number off the top of my head.

Thank you oBdA for your quick answer.
After looking at recent changes done on the server I noticed that this started after I changed the size of audit log file.

According to KB833167:
"Large Audit Log. Writer time-out errors might also appear during a system-state backup if the security (audit) log is extremely large. It is best to back up the system-state periodically, or to clear the log periodically.

Resolution This hotfix reduces the occurrence of this issue by permitting certain writers more time to prepare for the shadow copy process. This hotfix also changes the minimum initial shadow copy storage area from 100 MB to 300 MB."

I saved the audit log, deleted it and reduced the size under 100 MB. Now backup works OK.

I think this will be resolved in SP1 so I don't need the update now.

Thanks again for your responce.
