Digital Millinium Copyright Act, P2P question

I was wondering if anyone with knowledge of the DMCA could answer this simple question:

"If a legally purchased music cd bacame scratched, under the DMCA can the cd's tracks be downloaded from the web using P2P technologies (in order to replace the cd, that you purchased)?"

I understand there is a 'fair use' clause within the DMCA regarding making a back-ups or duplicates of any digital copyrighted material, but does that back-up have to come from the purchased media, Or, can the back-up come from a P2P network?

The crooks of the question, in the given senario is simple, are there legally permitable reasons to download copyrighted material?
