The Solution Rating System

With so many solutions, how can you tell which solutions are most likely to help you and which ones are not? SQL 2k: Subquery containing ORDER BY clause incompatible with UNION operator in main query

I am running SQL 2k SP4.  Here's a sample query of what I'm trying to accomplish.  It is simplified to highlight the specific issue:

SELECT PN.*
FROM FD__PROGRESS_NOTE PN
LEFT JOIN T4W_SIGNATURES SIG ON PN.OP__DOCID = SIG.OP__PARENTID
WHERE SIG.OP__ID IN (SELECT TOP 1 OP__ID FROM T4W_SIGNATURES WHERE OP__PARENTID = PN.OP__DOCID ORDER BY OP__WHEN ASC)
UNION ALL
SELECT PN.*
FROM FD__PROGRESS_NOTE___HEALTH_SER PN
LEFT JOIN T4W_SIGNATURES SIG ON PN.OP__DOCID = SIG.OP__PARENTID
WHERE SIG.OP__ID IN (SELECT TOP 1 OP__ID FROM T4W_SIGNATURES WHERE OP__PARENTID = PN.OP__DOCID ORDER BY OP__WHEN ASC)

Each entry in the progress note tables can have multiple entries in the signatures table.  I want to select the first signature associated with each progress note.  When running this code I get the error: "ORDER BY items must appear in the select list if the statement contains a UNION operator."  This error doesn't make sense to me because the ORDER BY clause is in a subquery so it shouldn't affect the UNION operator.  Is this a bug or is there something I should be doing differently?
