MS ACCESS IIF QUERY WITH MIN/MAX PROBLEM

I have table with fields:  ID,EmployeeID,DateTime
ID is auto-numbered field
and each EmployeeID can have many DateTime entries


I need query that returns (for chosen Day/EmployeeID):
0 when DateTime IsNull,
1 when min(DateTime)=max(DateTime),
2 when max(DateTime)>min(DateTime)

tried something like this:
SELECT IIf(IsNull(tblAttendance.DateTime),0,IIf(min(TimeValue(tblAttendance.DateTime))= max(TimeValue(tblAttendance.DateTime)),1,3)) AS Expr1, DateValue(tblAttendance.DateTime)
FROM tblAttendance
WHERE EmployeeID=2 And (DateValue(tblAttendance.DateTime)='7/20/2009')
ORDER BY DateTime, expr1;

But getting this error message
YOU TRIED TO EXECUTE QUERY THAT DOES NOT INCLUDE SPECIFIED EXPRESSION
IIf(min(TimeValue &.[&]&&
AS PART OF AN AGGREGATE FUNCTION

Whats the proper query in this case?
