Mine is actually set to "prompt" and I don't get a prompt with the code above. I changed it to "Enable" with no success either.

Far as I can tell it's not the browser... or at least the part of the code you've given is not affected by IE8 as the browser. It works just fine for me with prompt and enable settings....
Look for another piece of code ahead of this causing the breakdown.
I ran it in a function on page using body onload event (see snippet). Basic but proved your code works in IE8 on my machine at least.

unless user does this on his machine...
Tools -> Internet options -> Security -> custom level...
allow clipboard access
