How do I make a graphic in illustrator CS3 mac print as a spot colour when making a PDF.

I have a file that is 2 spot colours red and black, both colours split fine when I make a Press ready pdf but the black also converts a background tint that prints only in CYMK. The tint is a design that is a .psd graphic which I do no have as the file was supplied as illustrator eps to me.

I have tried a number of different ways to output such as making an eps and importing into quark/Indesign. Tiff , direct to PDF, postscript.

Any ideas?
