just a question why do you want to eject the primary tape pool? The normal function for TSM is to only eject the copy pool tapes

There is no such restriction with TSM, neither implicitly nor explicitly.
A CHECKOUT LIBVOLUME REM=YES (or MOVE DRM REM=YES for copypool volumes) will work under any circumstance.
I don't know your library, maybe it has some kind of "locking" mechanism.
