There's nothing special about a MP3 as opposed to other forms of digital content. You add your DRM to the file and allow buyers to download it after sale.

It's a problem, especially if you are a smaller seller and can't guarantee a certain volume level to get everyone to lower their fees for you. Apple could play hardball with merchants, you probably can't.
