If it is a one time email, then its legitamate. If the client provides updated deals or monthly news letters; then it would require an opt in.

I would recommend that if the no results are found, the page that tells them that also asks them if they would like to receive an email with the manual search from your client. Then you've covered your bases as you would have their permission for exactly that email. But a one-time use would not be a problem.

You will probably need to provide an "Opt In" option. This is for the client to say that they do or do not want to receive mail from you.
If you don't provide this the client may consider it unsolicited spam mail and get your e-mail domain put onto a spammer blacklists used by almost all e-mail providers.
Depending on where you are there may or may not be a legal obligation to provide the opt in.
