Standard compliance mode Rendering Issue with FF 3 (And I believe other versions) With simple markup

Gday Experts,

I'm just looking for some confirmation on this one. Is FF rendering this incorrectly according to the standards.

that big gaping white margin at the top is caused by the margins on the H1, however the background image is on its containing div, should the h1 be able to control the containing div's margin (obviously not)

Now If i apply some other formatting to the the containing div such as a border, the result is as desired

I have kept the markup and css to minimal so is easy to look at

If any of this is unclear or you do not have FF3 (although i believe the error will be on other version) see images below
