PHP script (deamon) seems to prevent apache to restart.

I've got a php script, which forks itself to run as a deamon.

This scripts get's started by a website (an admin panel) by using:
exec( PHP_BIN . ' -q ' . HANDLER_DIR . 'schedular.php 1> ' . LOG_DIR . 'schedular.' . time() . '.log 2> ' . LOG_DIR . 'schedular.' . time() . '.err & echo $!' );

The scripts starts and when apache stops, the php deamon keeps running where it has forked itself.

So far, so good....
untill I try to restart apache.
At this point apache won't start, where it says that the address 0.0.0.0:80 is still binded and that therefore it won't be able to start apache.
I've checked `netstat -lnp` and found that the php-deamon seems to be listening at this address.

The php-script has nothing coded into it that it should listen.

Someone who knows how to fix this?
