Incidently, the scanner is made by Artec, you can get the driver from their website as well:
http://info.ultima.com.tw/fae/Service_e/nl/home/Old_drivers.htm (Ultima 2000 E+ 48U)

the first link you posted is just a pdf file of the scanner. I had already found that thinking it was the driver as well. The second link I have already installed and when i start the program it says cannot find device. also it says "Twain Error! Failed to open Twain Driver."

any suggestions....?

I guess I should have asked, which did you install from the second link I gave, the full install + patch, or just the driver? And what happens if you go to Start -> Control Panel - Scanners and Cameras?

Are you positive that the scanner still actually works? Lights come on, etc?
Can you try installing on another machine, and see if you can get it to work?

yes i have read online all over the place that it has to do with the service pack 2 updates and whatnot. no actual fixes could be found.

The only other thing I can suggest is that it's a known issue with this scanner that you have to really push hard on the USB cable at the scanner end to get a good connection. You might try really shoving it in there. Here's a quote from an older forum message on the topic:
"You must plug in the USB cable into the back of your scanner ALL THE WAY and then the operating system will recognize
it. And when I mean all the way, you need to push HARD so the plug is in COMPLETELY. Then it should work."

Then my two suggestions are:
1) Try installing on another machine, and see if you can get it to work.
2) Shell out for a new(er) scanner. For under $100, you can get a lot of scanner these days.
