A UK based hosting company is using my Company Name...Legal Direction needed..

I run a web design and hosting studio in the US and have gone under my Business name since 2002.  I have had my company domain name registerted since that time.  In 2004 a UK based hosting company  started using the same Company Name and registered the same domain name except instead of .com they use .co.uk....  anyway, it hasn't been much of a problem until this year, they are actually coming up in google before us when someone searches the company name...my clients keep calling an emailing the UK by mistake...  I need to know if I should write the company a letter or just submit the google copyright infringement form etc...   any help would be greatly appreciated....Thanks  Jay

Unless you have TM your company name worldwide there is nothing to stop from someone in another country from registering a similar/same company name. You can get an attorney to write them a letter asking them to change their web address name and it may be enough to get them to do it. If they choose not to, it can become a very expensive legal battle. How much is it worth? It may actually just be cheaper to buy a top listing for your company from Google.
