Purchasing Windows 2008 Terminal Server Licenses for Windows 2003

Can I purchase Windows 2008 Terminal Server Licenses (per Device) and use them on a Windows 2003 Server? I don't want to upgrade my server to 2008 just so I can use it as a Terminal Server.

No, the CALs are specific to the version of Terminal Server you have. Besides, it isn't compatible in any event: http://support.microsoft.com/kb/839878

You cant - To load 2008 cals on 2k3 you need to have a 2008 licensing server

So according to jss1199, I can downgrade the Windows 2008 TS CALs to Windows 2003 TS CALs. I should just call the clearinghouse to request this or is there another way?

The point is, you are able to contact the clearinghouse and downgrade the licenses to 2003 so as to install on 2003 TS.  When you are ready to upgrade to 2008 you will need to contact them again to upgrade the licenses you purchased as 2008 and downgraded back to 2008.

Microsoft tackles this exact question in the Windows 2008 FAQ.  4th from the bottom under Client Access Licenses (CALs)  http://www.microsoft.com/windowsserver2008/en/us/licensing-faq.aspx#

You can downgrade them. It is possible. However, as both myself and ryansoto have mentioned, you can't use Server 2008 TS CALs on Server 2003 TS directly - they are incompatible.

OK. That's the way I understood it until those MS KB articles got posted... Then I got worried. If the question gets re-opened, will re-close it again.

Gonna leave the request to re-open valid just in case the other experts have additional comments.

Well, technically the answer to this is "You can't use TS 2008 CALs with TS 2003, they're incompatible". The workaround is to downgrade them to TS 2003 CALs by calling the clearing house. So both are valid.

The questions was whether he could purchase TS 2008 CALs and then use them on a TS 2003 server - Yes.  The downgrade is only part of the process to using them.  He is able to purchase 2008 CALs, perform a process to use them in 2003, and perform another process to use them in 2008 when ready.

Must always attempt to understand the intent of the question so that you can provide a factual answer.  :)
