Smart Array Controller reporting corrupt memory on HP 350 G4

I have recently discovered that the SATA ports on a clients HP ML350 G4p motherboard are faulty, apparently this is a known fault with the board and would have to be sent back to HP to be repaired, Not having the time or patience to do this, I have brought a Promise Fastrak TX2300 RAID controller to allow us to have a simple mirrored drive with a large capacity.

The card works perfectly, however when the machine is booting up the HP Smart Array comes up, detects the logical drive that contains our operating system (it is on a SCSI RAID 5 with 3 disks) and then comes up with the following error message:

1706-Smart Array Controller Extended BIOS Data Area Memory Corrupted. Int 13h BIOS Cannot Continue - System Halted.

Just before this screen comes up while it is loading the Smart Array, it allows us to press the space bar to skip, as long as we do this, the system will boot and both the HP Smart Array and the Promise mirror works fine.

However pressing space does skip the Promise configuration utility.

Does anyone have any idea how to fix this, as it makes it quite diffiicult to remotely support the site when someone has to be onsite for reboots.

I have upgraded both the system BIOS, the Smart Array firmware and the Promise controller has the latest firmware already.

I did google the issue and came up with a response to a similar issue with a E-SATA card, the fix was as follows, I have tried it but to no avail.

Disable the "Legacy SERR for PCI Express" option in the RBSU by performing the following:
Press the F10 key during POST.
Select "Setup Utility."
Select "Advanced Options."
Select "Legacy SERR for PCI Express."
Select "Disabled."
Press the F10 key to save the configuration and exit.
