Ghost files in sharepoint library. Cannot copy files because invisible file already exist

I am having a weird issue with our sharepoint document library. Our users have access to a document library with forms and often used documents from different department. The other day HR called me and said most of the forms in their folders and subfolders where gone. The document library can be accessed either by a network drive or through the sharepoint portal.

When I checked, indeed, the forms (Word Documents) where all gone. I tried to copy them back logged on as the main admin and each time get the "Cannot copy <filename>. the parameter is incorrect". If i changed the file name, then the file copy with no issues, Once I have copied the file and tried to rename it to the old name, then I get another error "Cannot rename <filename>. A file with the name you specified already exist. Specify a different file name". This is where I am confused as there a no file in the folder. I am logged on in sharepoint as the domain admin with all the rights and also show hidden files and I cannot see any files.

Also we do not use versionning. Any help would be appreciated. Not sure where those "ghost" files are or how to get them to be visible.

We use sharepoint 2007 spanned on 3 servers. One for the SQL database, one for the Sharepoint App itself and one for the frontend (Webportal)

open the doc library settings, and then mamaged checked out files see if they are there.  as an admin if there there you will see them
make sure you log in as site addmin to see them
domain admin has nothing on a site collection admin.

I think we are getting somewhere. I found a lot of file checked out. I took ownership of them. How can I check them back in?
Ok, it seems that even though the check in/out feature was turned off, it might have been turned on at one point and my boss checked out tons of files... I am deleting them right now and will replace them with new ones... I think it should be ok now...

Is there a way to cancel out the checked out files and therefore not show any of the files checked out so that I can replace them? I'd like to just copy the original folder with all the documents and be done with it without having to check each file to make sure they are not checked out?  Thanks!
