Split brain VM on ESX Host Cluster

Putting a host in my Cluster in Maintenance Mode has caused me an issue.

The VM now shows as bouncing between 2 hosts.  Meaning when I watch the Virtual Machines Tab in vCenter I see a VM appear and disappear.  When I click on the actual VM I see the Host reported as 1 of 2 hosts and it bounces back and forth.

Now this is preventing my Host from going in to maintenance mode.  What can I do to resolve this issue?  

I am running ESX 3.5.0 213532 on the host I am trying to get into maintenance mode to patch and the other is running esx 3.5.0 283373

disable DRS (uncheck from cluster)

I did already to no effect (other then loosing my Resource groups)

HA may be causing an issue to where it "sees" your 1 host down (but isn't...yet), and is trying to VMotion the VM over? I never heard of this happening before...interesting behavior. If you disable HA, does that rectify your VM's 'movement' behavior?

Have you disabled HA as well?

I believe DRS is required for the maintenance mode move to function.
Can one manual move the vm?

I had to shut down the esx host
