Does anyone know the legality of becoming a hosting provider? What guidelines do need to be in-place before we can start selling packages to private clients?

Unless you live in Syria, Libya, Iran or other similar countries, you need to be just a regularly registered business that accepts credit card information from its clients.
Things get a bit more complicated if you want to be an ISP, but I guess this is not your case.

You should use legal consulting to help you with the Terms of Service and the contractual agreements that you will have with your clients, especially limiting your indemnification and legal responsibility. Take a look at existing TOS hosting providers have.
Possibly, you will want to adhere to all kinds of regulations for your clients' benefits, like PCI, ISO9000 and others.
