Photoshop color scale slider

I am using Photoshop CS3 and have a slight problem with the color scales. When I drag a photo into the program, the colors remain.  As soon as I create a new layer or move the photo, the color scale changes from RGB Slider to Grayscale Slider.  I have tried clicking on RGB Slider but it does nothing. I cannot figure out how to get it back to th RGB Slider.  I have attached a photo of the scale I am talking about.

    Make sure your color mode is RGB.

    Image -> Mode -> RGB

    Also, your image didn't attach.
