Upgrading to InfoPath 2010 is not an option.

    Accepted Solution

infoPath and Outlook have to match.

Only other option is to have a coded email solution like an SMTP client or use browser based forms where SharePoint will send the email. has a database integrated solution which does serverside email as well.
probably you need to downgrade to InfoPath 2007.
