Possible to rewrite wordpress xmlrpc.php to save as 'pending'?

Is it possible to rewrite this wordpress xmlrpc.php file so that, instead of getting an error message when a user without the proper permission tries to publish, the post is saved as 'pending'?

The issue is that Windows Live Writer only allows two options - 'publish' and 'save as draft'. My writers need to save it as 'pending' so I know it's ready for review.

If they click on 'publish' in Live Writer, they get a message saying they don't have permission to publish (they don't, I'm supposed to check everything first).

Instead, it would be great if it would save as 'pending' rather than give them the error.
