Do customers have to opt in to get emails from us?

We want to send a mass email to every one of our current and previous customers asking them if they want to opt-in to our newsletter/mailing. Is this legal?

Keep in mind, none of them have opted in to anything at this point.

Here's the official info from the FTC: http://business.ftc.gov/documents/bus61-can-spam-act-compliance-guide-business   You can send to all of your customers since you have had a "business" relationship with them.  But you have to give them the ability to "opt-out" of newsletters and advertising.
