Seems that the application placed on hte UNC path won't launch when trying to launch via explorer either. What needs to be in place  for a application to launch from a UNC path?

The application didn't have the .net rights needed:
C:\WINDOWS\Microsoft.NET\Framework\v2.0.50727>caspol.exe -m -addgroup 1.2 -url "file:///\\server\applicationshare\folder\*" FullTrust -n test

This solved the problem.
