Exchange 2010 Mailbox issues

I had SBS2003 in place that had the ad and dns screwed up and I needed to expand my network, and unfortunatley they one way I could get sbs gone was very difficult. Nevertheless I have gotten all my ad, dns and replication issues fixed. NOW i have set up exchange 2010, and my predecessor gave some people exchange 2003 mailboxes in sbs, but we didnt use exchange in sbs as our mail server so I didnt know mailboxes were attached. Well when I am in the EMC and want to create mailboxes there are users that apparently have legacy mailboxes and the EMC wont let me create mailboxes for those users. SBS is completely gone at this point no mailboxes are recoverable at this point.

Any help would be great.

I have ran
Get-ExchangeServer |FL >C:\server.txt

Get-Mailbox |FL C>:\mailbox.txt

and have attached those logs.

The mailboxes are there in SBS and you are not using an exchange.
The mailbox attributes are still in AD. So the mailbox is already in AD.
That the reason you are not able to create the same users mailbox.

Are you able to create a new mailbox with new AD account?

yes, but I can not recreate everyones ad accounts...My employees are programmers, so I cant just recreate them. too many permissions to set back up...any other ideas?
I am asking to create a new test account and mailbox to check...

yes I created a new test account and I was able to successfully create a mailbox

So, what I understand you saying is that these users do not really have a mailbox, yet their AD account indicates that they do?

If so, you can use the Remove Exchange Attributes setting.  You'll probably have to install the Exchange 2003 Management Console to perform this task.  There is more info about it here:

I disagree.  The answer I provided will resolve the problem.  If it doesn't then the author needs to respond as to what occurred.

The original question stated that he wanted to create new mailboxes for some users but was unable to because those user accounts were tagged by AD as already having a mailbox (when, in fact, they did not).

I provided a link for very clear documentation on how to remove this attribute from the AD record so that he can then create a new mailbox as desired.
