Exchange 2010 Managing Lists Doesn't Work

We recently added an Exchange 2010 system and decommissioned 2007.  In AD I've granted a user to Manage certail DL's as well as Update them but he cannot.  The error he receives is:

"Changes to the public group membership cannot be saved. You do not have sufficient permission to perform this operation on this object"

Can you help?

Is that user listed as ManagedBy in the EMC on the DL properties ?

Also did you upgrade the DL's to Exchange 2010 ?

They are in fact listed as Managed By as well as have the ability to Modify the Group.  I did not rollout the new server do how can I check to see if the DL's were upgraded?

What if you create a new DL on the E2k10 EMC are users able to modify it if so will have to Upgrade the DL's to Exchange 2010.

Get-DistributionList "DLNAme" | FL

I was just told all of the DL's were upgraded to 2010.  I found this article; do you think it applies?

Run the first command before and after the second command and check if there is any difference

Get-DistributionGroup "DL Name" | FL

Get-DistributionGroup "DL Name" | Set-DistributionGroup –ForceUpgrade
