How do they do this flash header? Is it a picture with flash overlaid? Thanks.

It is a piece of Flash (.swf file) that contains the image and text you see. The water effect is a 'filter' that has been applied in Flash. For example something like - http://activeden.net/item/water-and-mirror-effects/full_screen_preview/10513

So the flash could be applied over an image, in Adobe flash, from what I see. But then it would be exported as a swf file.
