Help, how can an Apache server be using mod_rewrite WITHOUT a .htaccess file??

Hi there,
I have been asked to help a very sick site http://moggill.net and I see that is has got mod_rewrite as on and SEF urls as ON, however on the server there is no .htaccess file...only an htaccess.txt...how is this possible
????

This site has been hacked and I have clean and restored a number of times, removed JCE and upgraded, so I just can't find the problem, but now I have been told that there is something wrong with the htaccess  in that allows anyone access...however there is only a htaccess.txt file on the server.

What am I missing??

Check 'htaccess.txt' to see if it has what you need.  If it does, rename it to '.htaccess' because Apache won't recognize it as 'htaccess.txt'.  Note that mod_rewrite will also work in 'httpd.conf' and the virtual host 'conf' files.

well I don't really want to mess with the existing set up and the sef urls are working just fine, but I didn't know how on earth it could be without .htaccess in the root.
But you think it will work in .httpd.conf...where would I find that?

I have just asked for it to be reviewed....you can see it in IE
Until it is no longer listed in Firefox as an attack page, I won't be going there.
fair enough....it shouldn't have anything there though, files have been tested and it is clean...
I did clean it earlier in the week though and asked them to remove it which they did promptly....because I am asking for a second review I wonder if they are not so happy to remove it....'
Gosh I wish I knew what was causing it!
