What are the Qualifications for using a business name on a business card?

In starting a new business, how does one go about determining that the name is new or if it is not, whether one can use it in the geographic area they are in?

Start by applying for an assumed for your business.  Probably through your secretary of state.       Then you will want to register your trademark,  http://www.uspto.gov/trademarks/basics/
