Google and missing sitemap.xml

I have a sitemap.xml in the root directory of my site.
I have just run Test sitemap in google Webmaster tools
This is the message I got
1. the sitemap conforms to the Google requirements.
This is from the top of the sitemap.xml - the ERROR message from Google Webmaster tolls is below it

is the website static HTML or your using Content Management System (Joomla, Drupal, Word Press, ...)?
for the CMS there is ready plugin for Google sitemaps

the site is a combination of html and results and search pages built on the "fly" from the database.
