Toshiba are hard to get an RMA from...see this link

Basically they say you need to go the manufacturer of the laptop to get warranty support...I had issues with getting a hard drive RMA'd just a few weeks ago - tried going direct to Toshiba and couldn't find any RMA links - then found the above site...ended up going back to manufacturer of the machine to get the RMA...

I just realized that you said it was in a laptop.  Hard Drive Manufacturers don't warranty the drives that major Computer manufacturers use.  The Maker of the Laptop will be the one who warranties the drive.  If you bought it new it should have a complete 1 year warranty on it.  Unless it was somehow damaged by you it should be replaceable under their warranty.
