I'm trying to delegate the send as permission to a distribution group to another user and get the following error
error
Active Directory operation failed on SERVER. This error is not retriable. Additional information: Access is denied. Active directory response: 00000005: SecErr: DSID-03152492, problem 4003 (INSUFF_ACCESS_RIGHTS), data 0
I can go into AD users and computers and Add the users there and it works but cannot make these changes through exchange

It is, on the OU the group, and even the domain level.
Does it work for another group?

Yes apparently these hours were converted from exchange2003 initially
