Here is the query from the distribution list porperties > filter > preview (i removed the company name and replaced with dashes).

I have checked against other users in the same OU in AD and they are all there, except for this one employee.

I was mostly hoping for an area to check or something to look for, Thanks.

(&(!cn=SystemMailbox{*})(&(&(&(& (mailnickname=*) (| (&(objectCategory=person)(objectClass=user)(!(homeMDB=*))(!(msExchHomeServerName=*)))(&(objectCategory=person)(objectClass=user)(|(homeMDB=*)(msExchHomeServerName=*)))(&(objectCategory=person)(objectClass=contact))(objectCategory=group)(objectCategory=publicFolder)(objectCategory=msExchDynamicDistributionList) )))(objectCategory=user)(company=------------------*)(!physicalDeliveryOfficeName=Disabled))))

I'm getting an error in your conditions syntax when trying it on my end.  Can you post a screenshot of the gui Conditions tab?

This is the filter tab, as well - at this point, is it in my best interest to re-create or is there a "fix"

After tracking down the person that created it, i found that the distribution list is based on a query of the company field on the organization tab in the user properties in active directory

when i updated this field to match, the user showed up in the preview

thanks for you help
