Office 365 Pro Plus Open - on Thinstuff enabled Windows 7

I have a client with Windows 7 Pro installed as Virtual Machine on the MS Hyper-V 2012 server.
Multiple RDP sessions are enabled on that Windows 7 Pro with Thinstuff XP/VS server - turning it into "terminal" workstation.
There is Office 365 Pro Plus Open license installed on the Windows 7 Pro.
There are about 20 users accessing the "terminal" workstation.

As far as licensing legality goes I know that the MS Hyper-V 2012 is free and legal.


1. What license do I have to have to run Windows 7 Pro as Virtual Machine (accesses by 20 users)
2. Is Thinstuff XP/VS legal or is it a scam?
3. Can the Office 365 Pro Plus be legally installed and used on the VM - and being used by 20 users at the time?

hi mate,

i'm not a MS license expert but...

My answers:
1. it's hard to say do U really need any, in practice Thinstuff XP/VS is written in not official Microsoft recommendation how to write a software and how to integrate it with MS Windows so in strict theory using it may be a some kind of "strange" but it's also can't be illegal because of features it give to the customer (comparable with more expensive MS Terminal Server licenses), so in my opinion U don't need any additional license for that Windows 7 because U dont break a MS License agreement at all (but a Thinstuff XP/VS developer do that by writing so good feature sw), so no additional license for MS Windows in my opinion from U or your company
2. hmm, hard to say, it's legal software used with a lot of folks and companies, but MS may say they illegally use MS Windows to modify some MS Windows dll's and features which is not legal looking from MS License Agreement, so its hard to say, sw in my opinion if this sw should be quoted as an illegal MS have to go for a fight with Thinstuff XP/VS developer, which is not happening as I know (not sure of that, just not found info of that), so if they not go to court with this that mean its LEGAL SOFTWARE.
3. here problem is also a little... heeh, because officially Office 365 need 1 license (RDS licenses via the Volume Licensing program) per 1 user but from technical point of view U don't have RDS mode on Windows 7... heeeh, but in that case I will buy MS Office 365 RDS licenses via the Volume Licensing program to satisfy MS, even it's not necessary from technical setup.

Thank you - you make some really good points - I struggle with this question for a while. Whenever you talk to MS licensing "expert" - they end-up telling you that you should buy licenses for everything and double that.

1. My question here was more about running Win7Pro as VM - I am told I need VDI license for every device accessing it - is that correct?
2. I would agree
3. Most recent from MS licensing "expert" is that Office 365 enterprise level E3 or E4 subscription is needed.

can you comment on the #1 again?

hi mate,

1. hmm, yep MS stays that when U are using Win7 (Pro & Enterprise) as a vm U should buy VDI license, I and many judges don't agree with that because there is no difference between using os license between bare metal and vm if U are using it only on one 1vm or hw, sure MS stays that they have it in a license agreement but it's really discusable and with greater amount of license it will end up in judge and depends of country and lawers both sides may win, company when U show your right to use license everywhere U want even on your brain if U eventually can do that :P and MS lawers trying to stay on side that everyone that bought they sw must agree the license so must exactly folllow their rules which is absurd from a same assumptions because looking from this perspective every company that sells You a jeans may give U a usage agreement that they may be only used from 0900 am to 0400 pm and/or only from january to april, other use are illegal, its an absurd same like using Win7 os license only on hw but lot of companies do that and buy VDI subscryption, so I really cant answer your question for sure mate, because it always depends how good lawers U have and how money You may spend on them, and how many licenses concerned (20 looks not a huge ammount), depends also about general judge interpretation and practice on licensing disputes in your country/area. And good U observe that when U will get to VDI subscription U not only have to pay yearly (if nothing change in that matter) but U then have to buy licenses for every accessing user (so 20 in your environment).
3. I'm not up to date with newest licensing program of MS Office 365 mate, so not help here too much, just my interpretation with your little complicated not common situation.
