Can I update my phone with no Apple ID?

Recently someone hacked my Apple ID. I'm not sure how it happened, but I can't check emails, use my notes, and I can't do anything ICloud related like share pictures unless through iMessage. Other than that I'm not sure if I can update to iOS 9. I went to Apple and they only suggested a new phone. I can't get a new phone because my current, iPhone 5s has important documents I can not lose. They also don't know how to restore my Apple ID without losing the documents. Does anyone know how to fix these problems?

No.  Apple devices require an Apple ID.

Can you recover your Apple ID?

You can reset the password of your Apple ID via iforgot.apple.com  unless your email account associated with your Apple ID has also been compromised.
