I knew it does can join to SBS domain, just want to confirm if that is allowed to do it. if Microsoft Audit the license,  do I need to purchase different cal to support different server role?

Server 2012 also need to buy another 30 Cal

yes you can join a 2012 server to a 2008 SBS domain

is that legal to do that?

yes if you have the correct licenses

yes you need to purchase the appropriate CALs that will be used on the new server
your SBS licenses are valid for only SBS 2008; not for new versions of windows
you could also purchase a server license and CALs for 2016 which will allow downgrade rights to use on server 2012 / 2012 R2 which will allow you to use server 2016 if you upgrade to that

Server 2012 also need to buy another 30 Cal

if 30 users will be connecting to that server and using its resources, then yes, 30 CALs
always check with your reseller for the correct items and quantity you need
