Invalid XML character in a SWIFT XML Payload

Experts, the software solution that I work with outputs Soap XML message payloads to be sent on the SWIFT network. Some messages generated during edge case scenarios have unsupported XML characters like &, <, >, etc which are not escaped, and thus making the XML badly formed. My query:
1) Is it okay for the sender to send such badly formed SOAP messages and leave it to the receiver to handle it?
2) If you are aware of the SWIFT messaging network, does it prohibit the use of these characters in it's unescaped form?
Any inputs highly appreciated.
