We have two of these both acting up the same way
Is there a BIOS or software update or is this a HW issue?

Probably, it's not powered down but in sleep and has problems waking up. Holding that button for 10 secs is a hard shutdown after which you would need to press the button a 2nd time for powering up.
So, can you assure that these devices were shut down and not only looking like "off"?
